Definitions
Seller means Cornish Lavender Ltd of Great Carnbargus Farm, Carnbargus, Perranporth, Cornwall, TR6 0JG.
Buyer the person who buys or agrees to buy the goods from the Seller.
Conditions the terms and conditions of sale as set out in this document and any special terms and conditions agreed in writing by the Seller.
Goods the items which the Buyer agrees to buy from the Seller as set out in the confirmation of order.
Price the price for the Goods, as quoted on the Seller’s confirmation of order.
Conditions
These Conditions shall form the basis of the contract between the Seller and the Buyer in relation to the sale of Goods, to the exclusion of all other terms and conditions including the Buyer’s standard conditions of purchase or any other conditions which the Buyer may purport to apply under any purchase order or confirmation of order or any other document.
All orders for Goods shall be deemed to be an offer by the Buyer to purchase Goods from the Seller pursuant to these Conditions.
Acceptance of delivery of the Goods shall be deemed to be conclusive evidence of the Buyer’s acceptance of these Conditions.
1. Introduction
These terms and conditions govern the sale of products through our website www.cornishlavender.com, or via any retail outlet run by Cornish Lavender staff. By purchasing the Seller’s products (Goods), The Buyer agrees to abide by these terms. Please read carefully before placing an order.
2. Product Descriptions
The Seller strives to provide accurate and detailed descriptions of our products (Goods), including their ingredients, benefits, and suggested uses. However, due to the natural nature of these essential oil products, variations in colour, aroma, and packaging may occur. The Seller reserves the right to modify product descriptions without prior notice.
The Goods are sold as described in the confirmation of order.
2.1 Cornish Lavender Ltd draws the Buyers attention to the natural variations that occur within some of our product ranges that could result in the product looking different from the images on the website.
2.2 Where Goods bought through the website are unavailable, Cornish Lavender Ltd will endeavour to contact the Buyer to source an alternative product or to offer a refund.
2.3 The Seller reserves the right, but are not obligated, to limit the sales of our products or Services to any person, geographic region or jurisdiction. We may exercise this right on a case-by-case basis. The Seller reserves the right to limit the quantities of any products or services that we offer.
2.4 The Seller reserves the right to amend or change the specification of the Goods if required by any applicable statutory or regulatory requirements.
3. Usage Instructions
Essential oils can be potent substances. The Seller provides usage instructions and recommendations for dilution and application. Buyers are strongly advised to consult with a healthcare professional, particularly if they are pregnant, nursing, have a medical condition, or are taking medication. Misuse of essential oils may result in adverse reactions, and the Seller does not take responsibility for such incidents.
4. Warranties
The Seller offers no warranty other than that deemed by the Consumer Rights Act 2015.
5. Returns and Refunds

5.1. Unopened Products: If you are not satisfied with your purchase, the Buyer may return unopened products within 14 days of receipt for a full refund. Customers are responsible for return shipping costs unless the product was damaged or incorrect. Please contact the Seller for a Returns number. Regrettably, the Seller cannot accept returns of used products unless defective.
5.2. Opened Products: Due to hygiene and safety standards, opened products are non-returnable. If you experience a defect or issue with a product, please contact us within 14 days of receipt for assistance.
Refund Process: Refunds will be processed within 7-10 business days after receiving the returned item. Refunds will be issued to the original payment method used at the time of purchase.
6. Shipping Policies
The Seller aims to process and ship orders within 3-5 business days. Shipping costs will be calculated at checkout based on the delivery method selected and the destination. We do not currently offer international shipping. Please allow additional time for delivery during peak seasons or due to unforeseen circumstances.
6.1 Delivery of the Goods shall be made to the Buyer’s address. The Buyer shall make all arrangements necessary to take delivery of the Goods on the day notified by the Seller for delivery.
6.2 The Seller undertakes to use its reasonable endeavours to despatch the Goods on an agreed delivery date but does not guarantee to do so. Time of delivery shall not be of the essence of the contract.
6.3 The Seller shall not be liable to the Buyer for any loss or damage whether arising directly or indirectly from the late delivery or short delivery of the Goods. If short delivery does take place, the Buyer may not reject the Goods but shall accept the Goods delivered as part performance of the contract, and a pro-rata adjustment to the Price shall be made.
6.4 By ordering online your order will be dispatched to you by Royal Mail or another approved delivery company within five working days, unless otherwise stated.
7. Liability Waiver
By purchasing and using the Seller's Goods, the Buyer acknowledges that they understand the inherent risks associated with their use. The Seller is not liable for any adverse reactions, injuries, or damages resulting from the use or misuse of the Goods.
8. Privacy Policy
The Seller is committed to protecting the Buyer’s privacy. Personal information collected during the ordering process will be used solely for order processing and customer service. The Seller will not sell or share information with third parties without explicit consent, except as required by law. For more details, please refer to our Privacy Policy.
9. Intellectual Property
All content on our website, including product images, descriptions, logos, and branding, is the intellectual property of the Seller. Unauthorised use or reproduction of any content is prohibited. The Seller reserves the right to take legal action against any infringement of intellectual property rights.
10. Modifications to Terms
The Seller reserves the right to modify these terms and conditions at any time. Changes will be posted on their website, and continued use of services after such modifications constitutes the Buyer’s acceptance of the revised terms.
11. Limitation of Liability: THE BUYER’S ATTENTION IS PARTICULARLY DRAWN TO THIS CLAUSE
11.1 Nothing in these Conditions shall limit or exclude the Seller's liability for:
11.1.1 death or personal injury caused by its negligence, or the negligence of its employees, agents or subcontractors;
11.1.2 fraud or fraudulent misrepresentation;
11.1.3 breach of the terms implied by section 12 of the Sale of Goods Act 1979 (title and quiet possession); or
11.1.4 defective products under the Consumer Protection Act 1987.
11.1.5 any matter in respect of which it would be unlawful for the Contractor to exclude or restrict liability.
11.2 Subject to clause 11.1:
11.2.1 the Seller shall under no circumstances whatever be liable to the Buyer, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, for any loss of profit, or any indirect or consequential loss arising under or in connection with the Contract; and
11.2.2 the Seller's total liability to the Buyer in respect of all other losses arising under or in connection with the Contract, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, shall in no circumstances exceed £1000.
11.3 This clause 11 shall survive termination of the Contract.

13. Governing Law
These terms and conditions shall be governed by and construed in accordance with the laws of England and Wales. Each party irrevocably agrees that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with this Agreement or its subject matter or formation (including non-contractual disputes or claims).
These Terms and Conditions are valid as at 1 November 2024 and will be periodically reviewed as appropriate.
